1. About these terms
These Terms & Conditions (“Terms”) govern your access to and use of this website and your purchase of products from Cockroach Merchandise (“we”, “us”, “our”). By browsing the site or placing an order you agree to these Terms, our Privacy Policy, Shipping Policy, Refund & Return Policy and Disclaimer, which are incorporated by reference. If you do not agree, please do not use the site.
2. Definitions
“Site” means cockroachmerchandise.com. “Products” means the merchandise offered for sale. “You”/”Customer” means any person who uses the Site or places an order.
3. Nature of products (satire acknowledgment)
We sell satirical/novelty merchandise. By purchasing, you acknowledge and agree that the products and designs are independent satire and parody and are not affiliated with, endorsed by, or representing any political party, movement, organisation, or public figure (see our Disclaimer).
4. Eligibility
You must be at least 18 years old to place an order, or do so under the supervision of a parent or legal guardian who agrees to these Terms.
5. Products, descriptions & availability
We try to describe and show products accurately, but actual colours, shades, print placement and sizing may vary slightly due to screens, photography and the made-to-order printing process. Products are subject to availability and we may discontinue any item at any time.
6. Pricing & taxes
Prices are listed in Indian Rupees (₹) and are inclusive of applicable taxes, if any. Shipping is charged separately as shown at checkout (see Shipping Policy). We may change prices at any time. In case of an obvious pricing or typographical error, we may cancel the affected order and refund any amount paid.
7. Orders & acceptance
Your order is an offer to buy. We may accept or decline any order at our discretion — for example, due to stock, suspected fraud, errors, or delivery limitations. A contract is formed only when we confirm dispatch. If we cancel an order you have paid for, we will refund it in full.
8. Payment
We currently accept Cash on Delivery (COD) and any other methods displayed at checkout (online payment such as UPI/cards may be offered in future). For COD orders we may make a verification call/message before dispatch. Title to goods passes on full payment.
9. Shipping, returns, cancellations & privacy
Delivery timelines and charges are set out in our Shipping Policy. Returns, replacements, refunds and cancellations are governed by our Refund & Return Policy. Personal data is handled per our Privacy Policy.
10. Intellectual property
All original content, designs, artwork, text and layout on this Site are owned by or licensed to the store operator and may not be copied, reproduced or used commercially without permission. Third-party names/marks belong to their owners and are used, if at all, only for commentary/parody.
11. Acceptable use
You agree not to use the Site unlawfully; not to attempt to disrupt, hack, scrape or overload it; and not to infringe any third party’s rights. We may suspend access for misuse.
12. Reviews & user content
If you submit reviews or other content, you grant us a non-exclusive, royalty-free licence to use it in connection with the store. You are responsible for what you post, and we may remove content that is unlawful, abusive or infringing.
13. Disclaimers & warranties
To the maximum extent permitted by law, the Site and products are provided “as is” and “as available” without warranties of any kind, except those that cannot be excluded under the Consumer Protection Act, 2019 and other applicable Indian law, which remain unaffected.
14. Limitation of liability
To the extent permitted by law, our total liability arising out of any order is limited to the amount you paid for that order. We are not liable for indirect, incidental or consequential losses. Nothing here limits liability that cannot be limited by law.
15. Indemnity
You agree to indemnify us against claims arising from your breach of these Terms or misuse of the Site.
16. Force majeure
We are not liable for delays or failures caused by events beyond our reasonable control (e.g. courier disruptions, natural events, strikes, internet/payment outages, government action).
17. Governing law & grievances
These Terms are governed by the laws of India and are subject to the jurisdiction of the competent courts in India. Complaints may be raised with our Grievance Officer (see Contact), in line with the Consumer Protection (E-Commerce) Rules, 2020.
18. General
If any provision is held invalid, the rest remain in force. These Terms are the entire agreement between you and us regarding the Site. We may update these Terms at any time; the current version governs your use. We may assign these Terms; you may not without our consent.
